On Wednesday last week the DOT/FMCSA finalized a rule banning commercial truck and bus drivers from hand held use of mobile phones while driving.

As we’ve discussed previously, this is very important development for three main reasons:

1. The rule is crystal clear with regard to employer liability, stating that carriers are responsible for the actions of its employees and will generally be held accountable (fines up to $11,000 per incident) for violations that occur when drivers are carrying out company business or otherwise acting on the employer’s behalf.

2. The rule is silent with regard to recommended enforcement methods, choosing instead to clarify that an employer having a written policy in place is not sufficient enforcement, and if a violation occurs, the employer will still be held accountable for the employee’s actions.

3. Rules violations count against the carrier’s BASICS score under the “Unsafe Driving” category.

New Return Policy – Sprint Satisfaction Guarantee

Effective September 16, Sprint is updating its return policy for new lines of activation, upgrades, devices and accessories. The return and exchange policy will change from 30 days to 14 days for all channels and all customers, including Corporate Liable, Federal, State and Local Government.

While the old Sprint Free Guarantee goes away, the Sprint Satisfaction Guarantee still gives customers 14 days to fall in love with our products and services. If you are not 100% satisfied, bring it back within 14 days of activation and Sprint will:

· Refund the device purchase price (as long as the device is complete and undamaged).

· Refund the activation/upgrade fee (if service is cancelled within 3 days of activation).

· Waive the Early Termination Fee (ETF) (as long as the device is returned).

· Customers will only be responsible for usage charges (included but not limited to Monthly Rate Charges, add-ons, casual or out-of-plan usage and related taxes and Sprint surcharges) incurred while using the phone.

AT&T to start marketing new data network, but won’t sell separate plans

AT&T takes wraps off wireless data network

NEW YORK (AP) — Unbeknownst to most customers, AT&T has fired up a new wireless data network in five cities in the last few months.

On Sunday, the phone company will start marketing the network in Atlanta, Chicago, Dallas, Houston and San Antonio. But it won’t be selling a new data plan — use of the new “4G LTE” network will be a perk thrown in with existing plans, AT&T Inc. executive Kris Rinne says.

Rinne says the network will have downloads speeds of 5 megabits to 12 megabits per second. That’s in line with the speeds on Verizon’s LTE network, which launched late last year with separate data plans.

The LTE-capable devices AT&T sells are a tablet, two USB data sticks and a “mobile Wi-Fi hotspot.”
